Cold Mailer is engineered for targeted, individual professional outreach (job applications, developer networking, and B2B business inquiries). Using this platform for high-velocity unsolicited spam, deceptive advertising, or bought mailing lists violates these terms and will result in immediate termination.
1. Acceptance of Terms
By accessing or using Cold Mailer (the "Service"), provided at coldmailer.matchwize.com, you agree to be legally bound by these Terms of Service, our Privacy Policy, and our Anti-Spam & Responsible Outreach Policy.
2. Bring Your Own Key (BYOK) & Provider Terms
Cold Mailer operates on a Bring Your Own Key (BYOK) model. When you connect an email provider (such as Google Gmail, Google Workspace, Amazon SES, Resend, Brevo, SendGrid, or custom SMTP):
- You acknowledge that all sent emails are transmitted directly through your personal or organizational provider account.
- You remain solely responsible for complying with that provider's Acceptable Use Policies and sending quotas (e.g., Google's Email Sender Guidelines, Amazon SES Acceptable Use Policy).
- Cold Mailer does not bypass, override, or circumvent external provider rate limits, anti-abuse firewalls, or spam filters.
3. User Responsibilities & Conduct
You expressly agree that you will NOT:
- Use the Service to send deceptive, fraudulent, defamatory, or unlawful emails.
- Falsify sender headers, disguise "From" addresses, or use misleading subject lines.
- Import or dispatch to scraped, bought, or unverified email lists without legitimate professional context.
- Continue sending emails to recipients who have requested opt-out or removal.
4. Company Directory Usage
The company directory is provided for informational and direct job application/networking discovery. Users must not scrape, extract in bulk, or resell company information from Cold Mailer for commercial database redistribution.
5. Limitation of Liability & Disclaimers
The Service is provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind. Cold Mailer makes no guarantees regarding email deliverability rates, open rates, response rates, or job interview outcomes.
In no event shall Cold Mailer or its maintainers be liable for any indirect, incidental, special, or consequential damages resulting from your use of the Service or provider account actions (such as provider suspensions resulting from spam rule violations).
6. Termination
We reserve the right to suspend or terminate accounts that violate our anti-spam rules or acceptable use policies without prior notice.
